Baby! Calendar Contest: OFFICIAL RULES
1. ALL FEDERAL, STATE, LOCAL AND MUNICIPAL LAWS AND
REGULATIONS APPLY. VOID WHERE PROHIBITED.
2. Eligibility.
Subject to the additional restrictions below, the Oh Baby! Calendar Contest is
open to residents of the United States of America, 18 years or older at the
time of entry. Employees of The Repository, The Independent, The
Times-Reporter, The Suburbanite, About Magazine, and each of their respective
affiliated companies, and advertising and promotional agencies, and the
immediate family members of, and any persons domiciled with, any such
employees, are not eligible to enter or to win.
3. Contest Period.
The contest will begin at 8:00am on Friday, October 10, 2008, and will end at
midnight on Sunday, November 16, 2008.
4. How To Enter.
Beginning at 8:00am Friday, October 10, 2008 and ending at midnight Saturday,
November 1, 2008 (“Entry Period”), enter by submitting a photo of your child
with all required information. Photos must be submitted by an adult 18 years or
older. Children must be born on or after 1/1/05. The Times-Reporter reserves
the right to verify proof of age. Only one photo per entry per child. Multiple
births (twins, triplets, etc.) can be entered as one “baby photo” entry if all
the children are in one photo. Photos must be in color, minimum of 3” x 5” and
no larger than 5”x7” along with completed entry form as originals or on CD or
via email in jpg format. Digital photos must be 300 dpi. Parent or legal
guardian’s names and phone numbers must be included with all entries as well as
written on the back of each photo. All photos must be hi-quality files (240
res). Poor quality photos and/or photos not submitted in requested format will
not be accepted. Include your child’s name and the parent/guardian’s name,
address, phone number and consent to publish the child’s photo. Entry forms can
be found online at www.timesreporter.com/babyphotos, in The Times-Reporter or
at The Times-Reporter office, located at 629 Wabash Avenue NW, New
Philadelphia, Ohio (Office hours are 8:00am – 5:00pm Monday through
Friday.) Entries with incomplete or incorrect information will not be accepted.
Parent/guardian information will be verified by phone. Photos will not be
posted until information is verified.
Mail/In-Person Entry:
Enter by mailing or delivering the photo of your baby, along with a completed
entry form to “Oh Baby! Calendar Contest”, c/o The Times-Reporter, 629 Wabash
Avenue NW, New Philadelphia, Ohio 44663 (office hours are 8:00 am-5:00 pm
Monday-Friday). All mailed entries must be postmarked by October 30, 2008, and
received on or before November 1, 2008. In-person entries must be received by 5:00p.m.
Friday, October 31, 2008, the close of business for The Times-Reporter.
Online Entry: Online entry is
available at www.timesreporter.com/babyphotos. Complete the entry form, attach
the photo, complete any other required fields, and then submit your entry by
clicking on the “SUBMIT” button. Online entries must be received by midnight
November 1, 2008.
All photos become the property of The Times-Reporter.
Copyrighted photos must be accompanied by photographer’s release. Releases can
be faxed to: 330-364-8449, Attn: Oh Baby! Calendar Contest Photo Release. Name
of child, parent/guardian and contact phone number and e-mail MUST be included
on the release. The Times-Reporter reserves the right to refuse any photograph
it determines to be unacceptable. Baby photos will be displayed at www.timesreporter.com/babyphotos
and published in The Times-Reporter as space allows for voting purposes. All
parents and legal guardians of entrants specifically grant the right to The Times-Reporter
to publish the photo of their child in the newspaper and online at www.timesreporter.com/babyphotos.
5. Voting. Voting begins at 8:00am Friday,
October 17, 2008 and ends at midnight Sunday, November 16, 2008 (“Voting
Period”). Mailed votes must be postmarked by November 12, 2008, and received on
or before November 14, 2008. Online voting will end at midnight on Sunday,
November 16, 2008.
Voting is open to everyone – online voting is limited to persons 13 years
and older. You can vote for your favorite baby photo by submitting a voting
ballot along with a donation of $ 1.00 ($1.00 = 1 vote). Checks should be made
payable to The Times-Reporter. When voting online, the minimum donation is
$5.00 ($5.00 = 5 votes).
You can vote without making a donation by submitting an original ballot. One
free vote per form. One form per person per day. Original voting ballots will
be available in The Times-Reporter during the contest period and at The Times-Reporter
office. They can be mailed to The Times Reporter’s Oh Baby Calendar Contest,
c/o The Times-Reporter, 629 Wabash Avenue NW, New Philadelphia, Ohio 44663 or
may be dropped off at The Times-Reporter office between 8 a.m. and 5:00 p.m.
weekdays. Ballots which have been downloaded from www.timesreporter.com/babyphotos
or e-mailed are not considered original ballots.
The Times-Reporter will not be responsible for incomplete, lost, late,
postage-due, misdirected or illegible entries or for failure to receive entries
due to transmission failures or technical failures of any kind, including,
without limitation, malfunctioning of any network, hardware or software,
whether originating with sender or The Times-Reporter. In the event of a
dispute, all online entries will be deemed to have been submitted by the owner
of the ISP account from which they were sent. For these purposes, an ISP
account holder shall mean the natural person assigned to such ISP account by
the Internet access provider, online service provider or other organization
responsible for assigning ISP addresses for the domain associated with such ISP
account. All entries become property of The Times-Reporter. Any questions regarding
the number of entries submitted or the owner of an ISP account shall be
determined by The Times-Reporter in its sole discretion, and The Times-Reporter
reserves the right to disqualify any entries by persons determined to be
tampering with or abusing any aspect of the contest.
6. Winner Selection. One (1) Grand Prize
Winner and eleven (11) First Prize Winners will be determined by total votes
only. In the event of a tie, The Times-Reporter will randomly pick the winner
from the tied entries. Winners will be selected on or about Monday, November 17,
2008.
Prizes and Odds: Grand Prize: One (1) Grand Prize Winner will receive a $500
savings bond, have his/her photo featured on the cover of the 2009 Times-Reporter
Oh Baby!! Calendar, and will receive a complimentary 8X10 portrait, along with
10 free calendars. First Prize: Eleven (11) First Prize Winners will have
his/her photo heading a month in the 2009 Times-Reporter Oh Baby!! Calendar, a
complimentary 8X10 portrait, and three free calendars. The month will be
determined by The Times-Reporter. Runners Up: Runners up will receive a
complimentary calendar. Grand prize and First Prize winners must be available
to participate in a FREE photo session with assigned photographer between November
17 –December 1, 2008 in order to produce a professional quality photo to
be used in the calendar or risk not being included in calendar. Photos used in
the calendar will be chosen by The Times-Reporter in its sole discretion.
Odds of winning depend on the number of eligible votes received.
7. Winner Notification and Acceptance. Winners will be notified on or about Monday, November 17, 2008 at the
telephone number and/or e-mail address provided on winner’s entry form. The Times-Reporter
will call during regular business hours at number provided on entry form. If a
winner is unreachable after seven (7) days, or if that winner is unavailable
for prize fulfillment, an alternate winner will be selected. If The Times-Reporter
cannot find an eligible winner for the prize, that prize will not be awarded. To
claim a prize, the Grand Prize and First Prize winners must visit the
designated photographer the weeks of November 17 –December 1, 2008 for
photos to be taken or risk not being included in the calendar. All parents and legal
guardians of winners specifically grant the right to The Times-Reporter to
publish the photo of their child in the calendar. A valid photo identification
of the parent or legal guardian may be required and a photo release must be
executed. Winners may waive their right to receive prizes. Prizes are
non-assignable and nontransferable. No substitutions allowed by winner. Prizes
and individual components of prize packages are subject to availability and The
Times-Reporter reserves the right to substitute prizes of equal or greater
value. Winners are solely responsible for reporting and payment of any taxes on
prizes. Winners may be required to complete an affidavit of
eligibility/liability and publicity release (except where prohibited by law)
which must be returned within ten (10) days of date of personal delivery or
date of postmark. Failure to sign and return the affidavit or release within
ten (10) days, or to comply with any term or condition of these Official Rules,
may result in a winner’s disqualification, the forfeiture of his or her
interest in the prize, and the award of the prize to a substitute winner.
Except where prohibited, acceptance of any prize constitutes winner’s consent
to the publication of his or her name, biographical information and likeness in
any media for any commercial or promotional purpose, without limitation the
Internet, or further compensation. Prizes not won and claimed by eligible
winners in accordance with these Official Rules will not be awarded and will
remain the property of The Times-Reporter.
8. Participation. By
participating, entrants agree to be bound by these Official Rules and the
decisions of The Times-Reporter. The Times-Reporter reserves the right to
disqualify persons found tampering with or otherwise abusing any aspect of this
contest as solely determined by The Times-Reporter. In the event the contest is
compromised by a virus, non-authorized human intervention, tampering or other
causes beyond the reasonable control of The Times-Reporter which corrupts or
impairs the administration, security, fairness or proper operation of the
contest, The Times-Reporter reserves the right in its sole discretion to
suspend, modify or terminate the Contest. Should the contest be terminated
prior to the stated expiration date, The Times-Reporter reserves the right to
award prizes based on the entries received before the termination date.
9. Construction. The invalidity
or unenforceability of any provision of these rules shall not affect the
validity or enforceability of any other provision. In the event that any such
provision is determined to be invalid or otherwise unenforceable, these rules
shall be construed in accordance with their terms as if the invalid or
unenforceable provision was not contained therein.
10. The Times-Reporter. A portion
of all proceeds from The Times-Reporter’s Oh Baby! Calendar Contest will go
towards the Tuscarawas County Society for Children and Adults.. The decisions
of The Times-Reporter regarding the selection of winners and all other aspects
of the contest shall be final and binding in all respects. The Times-Reporter
will not be responsible for typographical, printing or other inadvertent errors
in these Official Rules or in other materials relating to the contest. For a
