The Times Reporter Oh Baby! Calendar Contest: OFFICIAL RULES 2009

 

NO PURCHASE NECESSARY TO ENTER OR WIN. ODDS OF WINNING DEPEND ON THE NUMBER OF ELIGIBLE ENTRIES AND VOTES RECEIVED.

 

1. ALL FEDERAL, STATE, LOCAL AND MUNICIPAL LAWS AND REGULATIONS APPLY. VOID WHERE PROHIBITED.

 

2. Eligibility. Subject to the additional restrictions below, the Oh Baby! Calendar Contest is open only to legal residents of the United States who are eighteen (18) years of age or older at the time of entry. Employees of GateHouse Media, Inc. and Copley Ohio Newspapers, Inc. , The Repository, The Independent, The Times-Reporter, The Suburbanite, About Magazine (collectively, “GateHouse Media”), and each of their respective divisions, affiliates, parent companies, subsidiaries, advertising and promotion agencies (including immediate family members or those living in the same household) are not eligible to enter the Contest.

 

3. Contest Period. The Contest runs for a total of five (5) weeks beginning at 8:00am Eastern Time on Saturday, October 10, 2009, and ending at midnight Eastern Time on Sunday, November 15, 2009.

 

4. How To Enter. Beginning at 8:00am Saturday, October 10, 2009 and ending at midnight Sunday, November 8, 2009 (“Entry Period”), enter by submitting a photo of your child with all required information. Photos must be submitted by an adult eighteen (18) years of age or older. Children appearing in submitted photos must be born on or after January 1, 2006. GateHouse Media reserves the right to verify proof of age. Only one (1) photo per entry per child. Multiple births (twins, triplets, etc.) can be entered as one “baby photo” entry if all the children are in one photo. Photos must be in color, a minimum size of 3” x 5” and no larger than 5”x7” and submitted along with completed entry form, as originals or on CD or via email in jpg format. Digital photos must be 300 dpi. All photos must be hi-quality files (240 res). Poor quality photos and/or photos not submitted in the required format will not be accepted. Include your child’s name and the parent/guardian’s name, address, phone number and consent to publish the child’s photo. Parent or legal guardian’s names and phone numbers must also be written on the back of each original photo. Entry forms can be found online at www.timesreporter.com/babyphotos, in The Times Reporter or at The Times Reporter front desk, located at 629 Wabash Ave. N.W., New Philadelphia Ohio 44663 (Office hours are 8:00am – 5:00pm Monday through Friday.) Entries with incomplete or incorrect information will not be accepted. Parent/guardian information will be verified by phone. Photos will not be posted until information is verified.

 

Mail/In-Person Entry: Enter by mailing or delivering the photo of your child, along with a completed entry form and all required information to “Oh Baby! Calendar Contest”, c/o The Times Reporter, Box 667, New Philadelphia, Ohio 44663 (office hours are 8:00 am-5:00 pm Monday-Friday). All mailed entries must be postmarked by November 4, 2009, and received on or before November 6, 2009. In-person entries must be received by 5:00p.m. Friday, November 6, 2009, the close of the business day for The Times Reporter.

Online Entry: Online entry is available at www.timesreporter.com/babyphotos. Complete the entry form, attach the photo, complete any other required fields, and then submit your entry by clicking on the “SUBMIT” button. Online entries must be received by midnight November 8, 2009.

 

All photos become the property of GateHouse Media and absolutely no photos will be returned. Copyrighted photos must be accompanied by photographer’s release. Releases can be faxed to: 330-580-2122, Attn: Oh Baby! Calendar Contest Photo Release. Name of child, parent/guardian and contact phone number and e-mail MUST be included on the release. GateHouse Media reserves the right to refuse any photograph it determines to be unacceptable for any reason. Qualified submitted photos will be displayed at www.timesreporter.com/babyphotos and published in The Times Reporter as space allows for voting purposes. All parents and legal guardians of entrants specifically grant the right to GateHouse Media to publish the photo of their child in the newspaper and online at www.timesreporter.com/babyphotos. Submitted photographs must not have been published or be under consideration for publication or prizes elsewhere.

 

Photographs that have been altered, manipulated or enhanced using computer software programs will not be accepted except as expressly provided below. Minor adjustments to the image such as removing dust spots, lightening or darkening areas of the photo, slight contrast or color adjustments and cropping are acceptable. If GateHouse Media determines an image has been altered, manipulated or enhanced, they reserve the right to disqualify it.

 

By entering the Contest, an entrant represents, acknowledges and warrants that either (a) the submitted photograph is an original work created solely by the entrant, that the photograph does not infringe on the copyrights, trademarks, moral rights, rights of privacy/publicity or intellectual property rights of any person or entity, and that no other party has any right, title, claim or interest in the photograph or (b) the entrant has, and has submitted to GateHouse Media, all necessary third party releases and consents to allow entrant to submit and GateHouse Media to exhibit and use such photograph as provided herein.

 

GateHouse Media will not be responsible for incomplete, lost, late, postage-due, misdirected or illegible entries or for failure to receive entries due to transmission failures or technical failures of any kind, including, without limitation, malfunctioning of any network, hardware or software, whether originating with sender or GateHouse Media. In the event of a dispute, all online entries will be deemed to have been submitted by the owner of the ISP account from which they were sent. For these purposes, an ISP account holder shall mean the natural person assigned to such ISP account by the Internet access provider, online service provider or other organization responsible for assigning ISP addresses for the domain associated with such ISP account. All entries become property of GateHouse Media and none will be returned. Any questions regarding the number of entries submitted or the owner of an ISP account shall be determined by GateHouse Media in its sole discretion, and GateHouse Media reserves the right to disqualify any entries by persons determined to be tampering with or abusing any aspect of the contest.

5. Voting. Voting begins at 8:00am Friday, October 17, 2009 and ends at midnight Sunday, November 15, 2009 (“Voting Period”). Mailed votes must be postmarked by November 11, 2009, and received on or before November 13, 2009. Online voting will end at midnight on Sunday, November 15, 2009.

Voting is open to everyone – online voting is limited to persons 13 years and older. You can vote for your favorite photo by submitting a voting ballot along with a fee of $ 1.00 ($1.00 = 1 vote). Checks should be made payable to The Repository. When voting online, the minimum fee is $5.00 ($5.00 = 5 votes).

You can vote without paying a fee by submitting an original ballot. You may submit one free vote per form per person per day. Original voting ballots will be available in The Times Reporter during the contest period and at The Times Reporter’s front desk. They can be mailed to The Times Reporter Oh Baby! Calendar Contest, c/o The Times Reporter, Box 667, New Philadelphia, Ohio 44663 or may be dropped off at The Times Reporter office between 8 a.m. and 5:00 p.m. weekdays. Ballots which have been downloaded from www.timesreporter.com/babyphotos or e-mailed are not considered original ballots and will not be accepted unless accompanied by the required fee.

6. Winner Selection. One (1) Grand Prize Winner and eleven (11) First Prize Winners will be determined by total eligible votes received, with the Grand Prize being awarded to the entry receiving the highest amount of votes, and the First Prizes being awarded to the 11 entries receiving the next highest amount of votes. In the event of a tie, GateHouse Media will randomly pick the winner from the tied entries. Winners will be selected on or about Monday, November 16, 2009.

Prizes and Odds: Grand Prize: One (1) Grand Prize Winner will receive a $500 savings bond, have his/her photo featured on the cover of the 2010 Times Reporter Oh Baby!! Calendar, and will receive a complimentary 8X10 portrait, along with 10 free calendars. First Prize: Eleven (11) First Prize Winners will have his/her photo heading a month in the 2010 Times Reporter Oh Baby!! Calendar, a complimentary 8X10 portrait, and three free calendars. The month will be determined by The Times Reporter. All other entrants will receive a complimentary calendar. Grand prize and First Prize winners must be available to participate in a FREE photo session with a designated photographer between December 6 and December 20, 2009 in order to produce a professional quality photo to be used in the calendar or risk not being included in calendar. Photos used in the calendar will be chosen by GateHouse Media in its sole discretion.

Odds of winning depend on the number of eligible entries and votes received.

The decisions of GateHouse Media regarding the selection of winners and all other aspects of the Contest shall be final and binding in all respects. GateHouse Media will not be responsible for typographical, printing or other inadvertent errors in these Official Rules or in other materials relating to the Contest.

7. Winner Notification and Acceptance. Winners will be notified on or about Monday, November 16, 2009 at the telephone number and/or e-mail address provided on the winner’s entry form. The Times Reporter will call during regular business hours at number provided on entry form. If a winner is unreachable after seven (7) days, or if that winner is unavailable for prize fulfillment, an alternate winner will be selected based on receiving the next highest numbers of votes. Upon forfeiture, no compensation will be given. If The Times Reporter cannot find an eligible winner for the prize, that prize will not be awarded. To claim a prize, the Grand Prize and First Prize winners must visit the designated photographer during the weeks of December 6 – December 20, 2009 for photos to be taken or risk not being included in the calendar. All parents and legal guardians of winners specifically grant the right to GateHouse Media to publish the photo of their child in the calendar. A valid photo identification of the parent or legal guardian may be required and a photo release must be executed. Winners may waive their right to receive prizes. Prizes are non-assignable and nontransferable. No substitutions allowed by any winner. Prizes and individual components of prize packages are subject to availability and GateHouse Media reserves the right to substitute prizes of equal or greater value. Winners are solely responsible for reporting and payment of any taxes on prizes. The potential prize winners waive the right to assert as a cost of winning the prize any and all costs of verification and redemption or travel to redeem said prize and waives any liability or claims (including attorneys fees) which might arise from redeeming or seeking to redeem said prize. Winners may be required to complete an affidavit of eligibility/liability and publicity release (except where prohibited by law) which must be returned within ten (10) days of date of personal delivery or date of postmark. Failure to sign and return the affidavit or release within ten (10) days, or to comply with any term or condition of these Official Rules, may result in a winner’s disqualification, the forfeiture of his or her interest in the prize, and the award of the prize to a substitute winner. Except where prohibited, acceptance of any prize constitutes winner’s consent to the publication of his or her name, biographical information and likeness in any media for any commercial or promotional purpose, without limitation the Internet, or further compensation. Prizes not won and claimed by eligible winners in accordance with these Official Rules will not be awarded and will remain the property of GateHouse Media.

8. Participation. By participating, entrants agree to be bound by these Official Rules and the decisions of GateHouse Media and release GateHouse Media, and each of its divisions, affiliates, parent companies, subsidiaries, advertising and promotion agencies and anyone associated with the production of this Contest, and their respective directors, officers, employees and agents from any and all liability for any claims, injuries, losses or damages (including attorneys fees) of any kind arising out of their participation in this Contest or resulting from acceptance, possession, use or misuse of any prize. GateHouse Media reserves the right to disqualify persons found tampering with or otherwise abusing any aspect of this Contest as solely determined by GateHouse Media. In the event the Contest is compromised by a virus, non-authorized human intervention, tampering or other causes beyond the reasonable control of GateHouse Media which corrupts or impairs the administration, security, fairness or proper operation of the Contest, GateHouse Media reserves the right in its sole discretion to suspend, modify or terminate the Contest. Should the Contest be terminated prior to November 20, 2009, GateHouse Media reserves the right to award prizes based on the entries received before November 20, 2009.

9. Construction. The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. In the event that any such provision is determined to be invalid or otherwise unenforceable, these rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein.

10. Proceeds. Ten (10) percent of all proceeds from The Times Reporter’s Oh Baby! Calendar Contest will be contributed to the The Rainbow Connection.
